It is the cause of more than 21,000 deaths each year, after all.<\/p>\n<p>Sadly, that\u2019s not the case. There aren&#8217;t many state radon laws that encourage\u00a0testing or\u00a0mitigation.<\/p>\n<p><a href=\"https:\/\/radonresources.com\/blog\/wp-content\/uploads\/2014\/10\/radon-levels-map-radon-resources.gif\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-674\" src=\"https:\/\/radonresources.com\/blog\/wp-content\/uploads\/2014\/10\/radon-levels-map-radon-resources-300x169.gif\" alt=\"Elevated radon gas levels across the country\" width=\"300\" height=\"169\" srcset=\"https:\/\/radonresources.com\/blog\/wp-content\/uploads\/2014\/10\/radon-levels-map-radon-resources-300x169.gif 300w, https:\/\/radonresources.com\/blog\/wp-content\/uploads\/2014\/10\/radon-levels-map-radon-resources-624x353.gif 624w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a>In the late 80\u2019s and 90\u2019s, there was a big push in state legislature. Radon was a hot issue and it was covered by many. Attention and awareness have\u00a0since died down, and laws related to radon have also fallen by the wayside.<\/p>\n<p>About 75% of the 50 US states do have some kind of law that addresses radon gas, but not in the way you might think. For example, most laws require radon professionals to be\u00a0nationally certified or licensed. Also, there are laws that require home sellers and realtors to disclose any known radon information about a property.<\/p>\n<p>No state radon laws, however, require homes be tested for radon during a real estate transaction. That is concerning, to say the least.<\/p>\n<p>We\u2019re going to take a look at some of the state radon laws that exist and what they entail.<\/p>\n<h2><strong>Radon Disclosure Laws<\/strong><\/h2>\n<p>About 30-40 states have radon disclosure laws. What this requires is simple. During a real estate transaction, the seller must disclose any and all known radon levels or testing results.<\/p>\n<p><a href=\"https:\/\/radonresources.com\/blog\/wp-content\/uploads\/2014\/05\/Radon-in-Real-estate.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-81\" src=\"https:\/\/radonresources.com\/blog\/wp-content\/uploads\/2014\/05\/Radon-in-Real-estate-300x147.jpg\" alt=\"Radon in Real estate\" width=\"300\" height=\"147\" srcset=\"https:\/\/radonresources.com\/blog\/wp-content\/uploads\/2014\/05\/Radon-in-Real-estate-300x147.jpg 300w, https:\/\/radonresources.com\/blog\/wp-content\/uploads\/2014\/05\/Radon-in-Real-estate.jpg 610w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a>If they have never tested the property for the presence of radon, then that\u2019s all they have to say during a home sale. This leaves the testing and mitigation on the shoulders of the buyer.<\/p>\n<p>A small list of states also requires sellers to include a warning about the presence of radon in the home. This is generally included in the sale contract or an amendment to the sale documents.<\/p>\n<p>The states that require a warning include:<\/p>\n<ul>\n<li>AK<\/li>\n<li>AZ<\/li>\n<li>DE<\/li>\n<li>FL<\/li>\n<li>IL<\/li>\n<li>KS<\/li>\n<li>MD<\/li>\n<li>ME<\/li>\n<li>MI<\/li>\n<li>MN<\/li>\n<li>MT<\/li>\n<li>NC<\/li>\n<li>NH<\/li>\n<li>NY<\/li>\n<li>OH<\/li>\n<li>OR<\/li>\n<li>RI<\/li>\n<li>SC<\/li>\n<li>SD<\/li>\n<li>TN<\/li>\n<li>TX<\/li>\n<li>WA<\/li>\n<li>WI<\/li>\n<\/ul>\n<p style=\"text-align: center;\"><a title=\"What Is a Radon Gas Disclosure and When Does It Apply?\" href=\"https:\/\/radonresources.com\/blog\/what-is-a-radon-gas-disclosure-and-when-does-it-apply\/\">Click here to learn\u00a0more about radon disclosures in real estate&#8230;<\/a><\/p>\n<h2><strong>Radon Certification Laws<\/strong><\/h2>\n<p>Radon certification laws address the businesses and professionals that will be dealing with radon\u00a0gas in homes. This includes companies that provide testing and mitigation services.<\/p>\n<p><a href=\"https:\/\/radonresources.com\/blog\/wp-content\/uploads\/2015\/04\/pro-radon-contractor.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-1139\" src=\"https:\/\/radonresources.com\/blog\/wp-content\/uploads\/2015\/04\/pro-radon-contractor-200x300.jpg\" alt=\"Complete Construction Safety\" width=\"200\" height=\"300\" srcset=\"https:\/\/radonresources.com\/blog\/wp-content\/uploads\/2015\/04\/pro-radon-contractor-200x300.jpg 200w, https:\/\/radonresources.com\/blog\/wp-content\/uploads\/2015\/04\/pro-radon-contractor.jpg 566w\" sizes=\"auto, (max-width: 200px) 100vw, 200px\" \/><\/a>20 to\u00a030 states have laws in place that require professionals to earn a certification or license before they can practice radon duties.<\/p>\n<p>The regulations outline procedures and requirements for qualifications, testing and mitigation standards, reporting and analytics, and finally penalties (for not following regulations).<\/p>\n<p>There are also third-party certification programs like the NEHA that work directly with state governments to license and qualify professionals.<\/p>\n<p>What this means for home and property owners is that you should always ask for qualifications when <a href=\"\/radon-contractors\/\">hiring a radon professional<\/a>.<\/p>\n<h2><strong>Radon Testing Laws<\/strong><\/h2>\n<p>The first thing you should understand is that there are currently no national or state radon laws that require testing in homes. This may seem counterintuitive to why these laws exist \u2013 and it is \u2013 but unfortunately, there\u2019s nothing that requires a lot of these properties to mitigate the issue.<\/p>\n<p>Currently, Rhode Island is the only state that requires radon testing for \u201cpublic or high priority buildings\u201d also. This includes places like the state courthouse, libraries, and similar public properties.<\/p>\n<p>Maine does require that residential buildings be tested for the presence of radon every ten years after they are built, unless they have a mitigation system installed. Yet, to have the property tested a tenant or landlord must request it.<\/p>\n<p style=\"text-align: center;\"><a title=\"Radon Resources - Radon Testing\" href=\"https:\/\/radonresources.com\/radon-testing\/\">Click here to learn\u00a0more about radon testing&#8230;<\/a><\/p>\n<h2><strong>Radon Mitigation Laws<\/strong><\/h2>\n<p>The following states require radon testing and mitigation if elevated levels are discovered:<\/p>\n<p>Mitigation in Schools:<\/p>\n<ul>\n<li>WV<\/li>\n<li>RI<\/li>\n<\/ul>\n<p>Mitigation in Child Care Centers:<\/p>\n<ul>\n<li>ID<\/li>\n<li>MD<\/li>\n<li>MI<\/li>\n<\/ul>\n<p>Mitigation in State Buildings:<\/p>\n<ul>\n<li>NH<\/li>\n<\/ul>\n<p style=\"text-align: center;\"><a title=\"Radon Resources - Radon Mitigation\" href=\"https:\/\/radonresources.com\/radon-mitigation\/\" target=\"_blank\" rel=\"noopener noreferrer\">Click here to learn more about radon mitigation&#8230;<\/a><\/p>\n<h2><strong>Radon-Resistant New Construction<\/strong><\/h2>\n<p>Finally, we have the radon-resistant new construction state radon laws. These require that new homes and buildings be constructed using radon-resistant materials and techniques. In theory, these locations should not experience radon issues, but it\u2019s still a good idea to test them regularly just to be sure.<\/p>\n<p>The states that have these laws in place include:<\/p>\n<p>Schools:<\/p>\n<ul>\n<li>CT<\/li>\n<li>NJ<\/li>\n<li>RI<\/li>\n<\/ul>\n<p>Homes:<\/p>\n<ul>\n<li>NJ<\/li>\n<li>MI<\/li>\n<li>WA<\/li>\n<li>MN<\/li>\n<\/ul>\n<h2>Help Raise Awareness<\/h2>\n<p>Now you see why we&#8217;re always talking about raising awareness for\u00a0the dangers of radon. Most of the state radon laws are necessary, but still lacking.
